Greed and Shamelessness in the South China Sea Issue

I am writing this blog not as a Filipino but as a Christian and as a member of the world community of people. I believe that the Chinese people I know will agree with me when I say that the Chinese government is wrong in their boastful assertion that they are ready for trouble if the decision reached at The Hague will be implemented!

I am addressing the Chinese Christians – those who are not communist like those who are in government of the People's Republic of China.

Three years ago, the Philippines filed for compulsory arbitration, under Article 287, Annex VII of the United Nations on the Convention on the Law of the Sea (UNCLOS), against China. The Philippines just scored a historic legal victory against China in the South China Sea. Meanwhile, China that boycotted the whole proceedings has refused to acknowledge its jurisdiction. China, which ratified UNCLOS in 1996, has said it will neither accept nor honor the upcoming ruling by the tribunal. Why is China wrong? It is wrong in principle, in moral, and in every aspect of justice! In principle, because it is signatory to the UNCLOS.

"When it ratified the Law of the Sea Convention, it agreed to all of the provisions of the convention and among the articles of the provision is Article 287 which says that one state may initiate an arbitration against another state unilaterally," Martin said in a public forum held at the University of the Philippines, Diliman.

Once a person or a group has agreed on a covenant and the covenant was ratified nobody may add or subtract to the conditions set forth.

It is utter shamelessness to disregard something you have agreed upon with others!

Under the principle of Estoppel, you must not disagree later with things you have previously agreed and signed!


Therefore, biblically and morally, China is wrong!

I have known Chinese people since my childhood. I remember my grandmother calling them "intsik." Most of them, with very little in their pockets, came to the Philippines, which was then considered as the richest country in Asia.

I remember when they humbly knocked on doors to buy empty bottles, cans, and stuffs that for ordinary Filipinos were meant to be thrown into the waste basket. These Chinese are humble. They are friendly. They are industrious and they do not waste money. Maybe this is the reason why they became successful as business entrepreneurs in the Philippines.

I am not, as I said, speaking as a Filipino, but as a Christian. My grandmother is of Chinese descent - a very industrious woman from Shanghai. Hard-working and diligent, she has passed on her virtues to us in the family.

I remember the now considered richest Filipino, the owner of the largest chain of malls and supermarkets in the Philippines, as a resourceful and frugal person! My father being a construction superintendent knew him personally. When his first store was being built in Escolta, Manila, this Chinese picked up every piece of nail lying idle within the construction site. He did not want a single centavo wasted. Now, after almost five decades, he is the richest Filipino and one of the richest men in the world. Mind you, he is Chinese by blood! These are the kind of Chinese people I know.

A considerable part of the Philippine population is Chinese by blood. They have learned to be religious also like Filipinos. Some, if not majority of them, have become Christians.

If the Chinese government did not consider the Philippines as home to most of its people seeking for greener pastures, which then are not available in China, how can the government of China be as inconsiderate to Filipinos now to the extent of harassing our fishermen in the South China Sea? This sea is by international law and agreement, part of our heritage! We have laws for that.

The Law of the Sea Treaty, formally known as the Third United Nations Convention on the Law of the Sea, or UNCLOS III, was adopted in 1982.  Its purpose is to establish a comprehensive set of rules governing the oceans and to replace previous U.N. Conventions on the Law of the Sea, one in 1958 (UNCLOS I) and another in 1960 (UNCLOS II) that were believed to be inadequate.

I would say that the Chinese occupation and construction activities in some of the islands, which by law belongs lawfully to the Philippines, is a premeditated act of greed, which is immoral by any standards!

Reports said that despite China’s complaints, the Arbitral Tribunal at The Hague stood its ground.

In its final verdict, it ruled China’s doctrine of ‘historic rights’, a foundation of its nine-dashed-line claims, as ‘incompatible’ with prevailing international law, arguing that ‘there was no evidence that China had historically exercised exclusive control over the waters or their resources.’

The verdict also makes it clear that China ‘violated the Philippines’ sovereign rights’ by preventing the Southeast Asian country from exercising its sovereign rights particularly its ability to exploit natural resources such as fisheries stock and hydrocarbon deposits within its Exclusive Economic Zone (EEZ) as provided by the UNCLOS. It also rejected China’s longstanding claim that the contested land features in the Spratly chain of islands — particular Mischief, Gaven, McKennan, Hughues, Johnson, Cuarteron and Fiery Cross reefs — as well as the Scarborough Shoal constitute naturally-formed islands. I am not against the Chinese people but I am against the rudeness of their leaders. It could be because they are not Christians!

  4. It's true, the Chinese government must keep their word. If they are signatories to the UNCLOS, then by all means they must honor the UN Tribunal decision on the West Philippine Sea - because this is a judgment based on the UNCLOS agreement.

  5. The Chinese' refusal to accept the decision of the UN tribunal is not only the concern of Filipinos, but also THE WHOLE OF THE UNITED NATIONS. China is a signatory of the United Nations. That being, they agree to adhere on the laws as well as the decisions of the UN. Now if they will continue to refuse to follow the rulings, this is a blatant disrespect to all the nations in the world who respect the UN.

If I were not a Christian, specifically an MCGI, I would probably have a different point of view on this platitudinous issue in the Philippines about the International Tribunal in Hague’s conclusion that China has no legal basis to claim historic rights to the bulk of the South China Sea which was rejected by the Chinese President Xi Jingping. And while I could tackle the issues particularizing to China’s breach of the Philippines sovereign rights by interfering with Philippines economic zone and overlapping claims on historical basis --- I would like to leave that discombobulation amongst the countries involved. Though I have a political viewpoint on China’s assertion and claim of the sea, I don’t want to dissertate on this because it’s appositeness does not improve nor alter China’s stand on it.
    What I want to react on would be about the perfect title of this blog which pertains to China’s GREED and SHAMELESSNESS. Bro.ELI showed us here how important a “covenant” is where he referenced Galatians 3:15 in the bible and under the principle of legal doctrines in common law of estoppel which is a contradiction to judicial determination. Now why this struck me is because if human law exercises “covenant” pertinence and credibleness in the court, how could we diminish the uttermost respect our GOD deserves as far as our covenant with HIM is concern? Or at a lighter perspective, how can you promise to marry someone and at a spur of a moment tell that someone that were just joking about it? And Bro.ELI defined this issue as a matter of Greed and Shamelessness. I cannot agree more. That suffices the perfect description of China’s violation of maritime rights.
    And yes I remember those days when Chinese or “CHEKWA INTSIK TULO LAWAY” as they were branded then, would knock on your door to buy bottles and metals (junks) for like 15 to 30 centavos which they sell for recycling. Those were the humble days when Chinese in the Philippines were the low class citizens which of course in contrary to their prominence now – owning the biggest industries in the Philippines. I salute their industriousness and dominance in trading and multitude of business. They are good merchants. But love of money in a manner of speaking will never give salvation. This is where religion matters. Being in the right church with the right doctrines , the right faith and the right religion…. Would give us the right values in dealing with the right people.
    Is it worth dying for? I’d say no. Is it worth fighting for? Maybe. But this issue will never expose the other hidden truths behind the purpose and intention of China. Analogous to the Vietnam war that the Americans fought and died for without truly knowing why it’s worth the war.

  58. Kung hindi pa naging Presidente si Duterte, ni hindi man mauungkat ang issue na ito ng pag-aangkin ng CHINA sa property ng Pilipinas. Ang hinala ko pa nga, may mga opisyal na sa gobyernong Pilipinas ang nasuhulan para magbulag-bulagan sa pagtatayo nito ng isla na hindi maaaring makalampas sa mata ng mga Philippine Coastguard o ng satellite ng Sandatagang Pilipinas. Paano ka makakapagpatayo ng isla sa teritoryo ng Pilipinas na hindi man napansin ng ating gobyerno? Hindi naman iilang oras lang ang gugugulin ng CHINA para matabunan ng lupa ang dagat at makapagpatayo ng isla. Ngayong naging Presidente na si Duterte, bakit nabuksan ang issue na ito ? Kahina-hinala. Pero hindi naman dito tumutukoy ang blog ng kapatid na ELI. Inaaaral sa atin ang kahalagan ng KASUNDUAN. Hindi pwedeng ang sinabi ko kanina ay itanggi mo bukas. Kumbaga sa usapang lalake, walang bayag kausap, sa kolokyal na salita. Pero hindi naman ito gentleman's agreement na nakukuha sa kamayan. Mayroong mga legal na dokumento ang magpapatunay sa kanilang napagkasunduan. Pero magtataka ka pa ba kung ang kaibigan mo nga mismo ay pwedeng traydurin ka pa rin balang araw lalo na kung pakinabang ang pag-uusapan. Lalo pa na mas madali para sa mga hindi natin kalahi ang tablahin tayo dahil sa malaking pakinabang.
    Gaano pa talaga kahalaga ang pakikipagtipan (covenant)? Masasabi ba nating ayos lang sumira sa kasunduan dahil tao naman ang kausap at hindi DIOS? Yun nga ang pinto eh . Kung sa tao lang na katipanan mo ay sumisira ka na ….tao na maaari kang ihabla….habulin….saktan at ipapatay --- sa DIOS pa kaya na hindi mo nakikita? Sa isip ng taong walang pananampalataya, pwede niyang isipin na madaling sirain ang tipan sa DIOS dahil hindi mo naman nakikita ang DIOS hindi gaya ng tao na maaari kang saktan. Kaya dahil mas malakas ang sandatahan ng bansang CHINA kumpera sa Pilipinas ay malakas na ang loob nilang sabihing kayang-kaya nila ang Pilipinas kung puwesahan lang pag-uusapan. At dahil walang halaga sa kanila ang pakikipag tipan sa tao, ay lalong wala naman silang DIOS na inaalala na gaganti sa kanila. Diyan na pumapasok ang kamangmangan ng TAO.
    Paano ka makakakain ng pagkaing ninakaw mo lang? Kahit ano ang sarap ng kakainin mo ay hindi mo siguro yun malalasahan dahil hindi naman talagang iyo. Bahala na ang DIOS. May hustisya ang DIOS sa mga lapastangan at mapagsamantala.
    Salamat sa DIOS sa napakagandang blog kapatid na ELI. Sa DIOS ang lahat ng kapurihan!

    Power can corrupt and make a person boastful, arrogant, self-conceited, rude, shameless, inconsiderate, disrespectful, uncompassionate, apathetic, greedy, twisted, inconsistent, immoral, unjust and unreasonable. Those who do not have strong moral values, most probably ones without bible-based principles, are most vulnerable to this corruption. China has been high and drunk with its super powers for quite some time now. It now contradicts itself when it says it will dishonor the upcoming ruling by the tribunal. Hence, it is not worthy of trust and goodwill anymore. China has crossed the line. The World must show that China cannot be The Boss. China must stop, or else The World should stop China.

China disregards and violates the law of the sea to claim that the West Philippine Sea including the Kalayaan Group of Islands is in the Chinese territory because in accordance of the law states that an island or a group of Islands, for it is in the possession of one country must be within 2000 nautical miles and must be in the exclusive economical zone. Kalayaan is within the jurisdiction and boundary of Philippine territory. How come why China claims that these islands is theirs while these are more than 2000 nautical miles from Chinese jurisdication? How can that be?

  72. We can base it by law and by God's word (Bible)... But if the Chinese leaders do not acknowledge the ruling, what more consider what the Bible says... China is a communist country, they don't believe in religion.
    The sad thing is, because the Philippines is a military weak country, there is nothing we can do, really.
    I don't hate the people, it's the way their government treats weaker countries like us, makes me think they are bullies... Makes me put more effort to boycott Chinese products as a way of showing my disapproval of Their actions.

They even break the sovereign right of the Philippines just to get what they wanted.They also disregard what has been agreed which is an immoral practice.   99. One of the solutions to effectively fight back in China's aggression is boycotting their products. Don't buy any Chinese products. I hope all Filipinos will stop buying any Chinese item in the market around the world. The only way to cut their expansionism. I know it will have impact in their economy with millions to feed. This is art of war this new age. Let us unite this effort. I hope this suggestion will start with our president. GOD helps us.

But the problem I guess is that they do not care about morals and the teachings of the Bible. They act less civilized. They (although not all of them) are greedy. May God show them that even if Philippines is a small country unlike them, we are far more civilized and blessed!

They must stop in their bullying of our poor fishermen whose only source of income is fishing among the disputed territories especially the part of the Scarborough Shoal. Right is still the most right than might.

  118. siguro takot sila masakop ng west/u.s. ngaung nagiging superpower na sila, kaya tinatapatan nila yung mga u.s. military bases sa Asian countries. pag nagtayo sila ng military base sa gitna ng south china sea, hanggang dun lang yung gera hindi makakapasok sa mainland.
